The Obama administration was all too aware that at least some insurers or states would refuse to sell family policies to gay and lesbian couples who signed up for the Affordable Care Act (ACA).
Stephen Koff, The Plain Dealer’s Washington Bureau Chief, reports on a family in Gates Mills, Ohio, suing the federal and state governments in U.S. District Court in Cleveland over being denied a family policy through the ACA marketplace, which the couple argues violates their constitutional rights.
The only option the plaintiffs, Alfred Cowger Jr., Anthony Wesley Jr. and their 7-year-old daughter, Catherine have is to buy insurance individually, but that option denies them rights other couples have; namely, to be eligible for tax subsidies based on their income. It additionally forces them to have deductibles that are a third higher than they would be if they could get an ACA marketplace policy as a family. http://is.gd/JLZjds
